Frequently asked questions
What should I do if police want to question me?
You are generally not obliged to take part in an interview, and what you say before you have advice is very difficult to undo afterwards. You can say that you want to speak to a lawyer first. That is not evidence of guilt and it cannot be used against you.
Will I lose my licence for drink driving?
It depends on the range, your record and whether the court is persuaded to deal with the matter without a conviction. Disqualification periods have statutory minimums, so the realistic question is usually how long rather than whether.
What happens at the first mention?
The court confirms the charge, asks how you intend to plead, and sets the matter down for what follows. If you have not had advice yet you can ask for an adjournment to get it.
Can an AVO be made without admissions?
Yes. An order can be made by consent without any admission as to the allegations. Whether that is the right course depends on what the order would restrict and what else is on foot.
Do I need a lawyer for a common assault charge?
Not always, but the consequences of a conviction reach well beyond the penalty — travel, employment and visa status among them. Advice before you enter a plea costs a fraction of what an avoidable conviction does.
